Web Hosting Terms of Service
Hurricane Technology offers services to clients around the world.
Hurricane Technology has the responsibility to protect each client and serve them at the highest level possible.
The following guidelines were designed to insure these services.
Content:
All services provided by Hurricane Technology may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, unlicensed software or files, or material protected by trade secret and other statue. The subscriber agrees to indemnify and hold harmless Hurricane Technology, Inc. from any claims resulting from the use of the service which damages the subscriber or any other party.
Site Feature Restrictions:
Certain site features, such as client FTP access to Websites and running Web applications, and other features, initially require a co-managed approach with Hurricane.
Examples of non-acceptable content or links
* Pirated software
* “Illegal MP3’s”
* Hackers programs or archives
* Warez Sites
* Child Pornography
Hurricane Technology will be the sole arbiter as to what constitutes a violation of this provision.
Ownership of software:
Hurricane offers “software as a service”, and other often bundled or promotional, software features for its web hosting clients. Examples of these features include, but are not necessarily limited to, HTML pages, automated email notification features, database driven forms, free Website setup (including CMS systems), database queries that display results on JSP or other pages, custom CMS system logic, and other custom site features. Unless otherwise negotiated in writing between Hurricane and the web hosting customer or other client that software ownership for a particular piece of software, or other site functionality Hurricane created, transfers to the client, the software for these services, and all other software on our server(s), remain the exclusive property of Hurricane Technology, Inc.
Unlimited Traffic/Hits & Server Resource Usage:
Hurricane Technology is pleased to offer our clients unlimited traffic/hits, and server usage. Unlimited Traffic/Hits refers to the number of visitors to your website, NOT the amount of bandwidth/data transfer. Your account is still limited to the allotted bandwidth/data transfer included with your selected package. To maintain the integrity of our service the following traffic/usage limitations apply.
* Sites with banners, graphics or cgi’s running from their domain being used on other domains.
* Sites with immense graphic archives or galleries.
* Sites offering immense download archives, such as .zip, .tar, .ra and .GZ.
* Sites running large chat room gatherings.
* Sites using more than 20% of system resources
If you do not qualify for unlimited traffic/hits, your account may be required to be upgraded, or, Hurricane Technology may move your site to a different server, to reduce the load on the server you are currently residing. Hurricane Technology will be the sole arbiter as to what constitutes a violation of usage limitations. Bandwidth/data transfer will go unmonitored until you reach your account limit, then normal over-usage data transfer costs will apply. Chat Rooms:
Hurricane Technology currently does not allow clients to install their own chat rooms.
Background Processes/Programs
Hurricane Technology may allow programs to run continually in the background. A description of these programs/processes must be submitted to Hurricane for review and each program or process is considered separately. An extra charge may be incurred based on system resources used and operational maintenance needed.
Cron Jobs:
Hurricane Technology does allow Cron Jobs to be conducted on our servers with the appropriate hosting package options.
IRC:
Hurricane Technology currently does not allow IRC or IRC bots to be operated on our servers.
Multiple Connections:
Multiple telnet and ftp sessions are allowed, on a single hosting account with the appropriate hosting package options.
Idle Timeouts:
Hurricane Technology may disconnect any idle connection to the network.
Average timeouts are:
FTP – 300 seconds
Telnet – 2 hours
Commercial Advertising – Email:
Spamming, or the sending of unsolicited email, from a Hurricane Technology server or using an email address that is maintained on a Hurricane Technology machine is STRICTLY prohibited. For general reference, we consider spam any email that is sent to more than 10 people at a time that did not ask for it to be sent to them.
Hurricane Technology will be the sole arbiter as to what constitutes a violation of this provision. Opt-In email is acceptable, as long as Opt-Out/Removal request are fully honored. Please make an effort to limit outgoing mail on your account to no more than 5000 pieces per DAY and no more than 20 pieces per minute. Many times we have seen sites push over 1000 emails in one hit, this causes extreme server loads and prevents other people from accessing server services. Large mailings are preferred to be sent from the hours of 12AM – 8AM EST. Sites with large mailing databases, need to be placed on dedicated server or VPS platform.
Server Abuse:
Any attempts to undermine or cause harm to a Hurricane Technology Inc. server or customer of Hurricane Technology. is strictly prohibited. Hurricane Technology will pursue legal action to the fullest extent for all abuse of the Hurricane Technology Network.
Suspension/De-Activation:
If any terms or conditions are failed to be followed it will result in grounds for account suspension or de-activation. Hurricane Technology reserves the right to remove any account without prior notice. If Hurricane Technology deactivates your account(s) for violating policy, your will forfeit your rights to a refund…and none will be given. No refunds for advance payments, on de-activated accounts. Normal policy is a warning first, and account de-activation the second offense. Serious offenses may cause immediate de-activation.
Privacy Policy
Hurricane Technology respects the privacy of every individual who visits our Web sites, responds to our interactive advertisements or sends us e-mail. This Privacy Statement outlines the information Hurricane Technology will collect and how we will use that information. This Statement will also instruct you on what to do if you do not want your personal information collected or shared when you visit Sprint Web sites, respond to our Web-based advertisements or send us email.
All order forms on Hurricane Technology may utilize a Secure Socket Layer (SSL) or Secure Electronic Transaction (SET) protocol to secure sessions for our visitors. Through the “secure session”, information that you input into a Hurricane Technology order form will be sent and will arrive privately and unaltered at a Hurricane Technology server. This security helps ensure that other companies and Web users cannot access your information.
Hurricane Technology will not collect any personally-identifiable information about you (that is, your name, address, telephone number, or email address) unless you give it to us voluntarily.
If you do not want your personally-identifiable information collected, please do not submit it to us. If you have already submitted this information and would like for us to remove it from our records, please contact us at the email address listed at the bottom of this Statement. We will use reasonable efforts to delete your information from our existing files.
When you do give us with personally-identifiable information, we may use that information in the following ways, unless stated otherwise:
* we may store and process that information to better understand all customer needs and how we can improve our products and services for all customers
* we may use that information to contact you with new promotions and announcements if you have previously provided your permission and if the promotions and announcements are in your interest
* we may contact you if we have questions about your account
Hurricane Technology will not sell personally-identifiable information to third parties, unless stated at the time of collection. We may share your information with business partners, but we are committed to giving you the “opt in” choice whether we use your information for marketing purposes or whether we would share information with business partners.
Changes to Terms of Service:
Hurricane reserves the right to change these Terms of Service at any time for any reason.
Site Maintenance
Unless otherwise negotiated in writing with a client, site maintenance or other customer support is not included with site Hosting. For static HTML-only (that is, with no active content) sites, whether to maintain the site is up to the customer.
Due to the ramifications of hacked or otherwise compromised Content Management Systems (CMS) sites, however, a monthly site maintenance contract is required for the client to host a CMS with Us.
Hurricane offers T&M (Time and Materials) support and other pre-negotiated support contracts.
Payments to Us
Although we will follow up with reminders to the domain email about payment due notices, it is up the client to make timely payments.
Starting April, 2020, and going forward, we will accept payments for hosting, or for other services we offer, using any of the three preferred methods below:
1. PayPal (see our Payments page)
2. USPS Yearly Paper Checks for Hosting Clients
3. ACH Payments
(Note: monthly paper checks still accepted, but not preferred.)
Late or non-payments will be handled as described below (holidays and mail non-delivery days are included with due dates):
- Any Accounts — including web and email — will be suspended after the 10 day grace period from the payment due date. Suspended accounts are non functional. Accounts may have an “Account Suspended” notice on the web page. For example, if a payment was due on the 1st of June, but full payment not received by June 10th, then that account (web/email) would be suspended on June 10th. Web sites and email are not usable once suspended.
- Any Accounts — web and email — will be terminated and all data on server permanently deleted if payment is still not received 30 days from the due date. That data includes email data for IMAP accounts, Web site and Web site data, and all other data. For example, if a payment was due on the 1st of June, but full payment still not received by June 30th, that account would be terminated and all data (web/email) permanently deleted on June 30th. Following this site termination and deletion, it would then be up to the client to point their domain name to a working/valid site.
Should any payment’s due date fall on a holiday or on a mail non-delivery day, it is up to the client to make sure to send payment in time so it will be received before that holiday.
Refunds
Upon written request within two weeks (14 days), from the site owner, for site cancellation, deactivation, or moving the domain name that Hurricane hosted to another web hosting provider, Hurricane will refund a prorated remainder of the contract term paid.
